Privacy Notice of Arthrex GmbH

You should be aware of the following:
We store and process your personal data for the purposes specified in the consent form. The legal basis for processing your data is your consent (Art. 6 par. 1 lit a of the General Data Protection Regulation – GDPR).

You should be aware that your consent is voluntary, and that you may withdraw your consent at any time. You will not be exposed to any sanctions if you refuse to consent or withdraw your consent. The withdrawal of your consent will neither affect the lawfulness of processing your data based on such consent before such withdrawal nor prevent us from processing your data on any legal basis other than your consent.

We archive your consent for the purpose of documenting that you have consented to the processing as described above. The legal basis for such archiving is our legitimate interest (Art. 6 par. 1 lit f, of the GDPR) in documenting your consent. For the purposes described above, we will retain your data for the duration of our business relationship and thereafter, in view of the statutory limitation periods, for 4 more years and will then delete or anonymize the information.

You should be aware that we will not use your personal data for any decision based solely on automated processing that produces legal effects concerning you or similarly significantly affects you. Under the conditions stipulated in Art. 15 of the GDPR, you have the right to obtain confirmation from us as to whether or not personal data concerning you are being processed, and, where that is the case, access to the personal data and certain information on their processing. Please note that this right is subject to certain statutory limitations (in particular under § 34 of the German Data Protection Act). Under the conditions stipulated in Art. 16 of the GDPR, you have the right to obtain from us the rectification of inaccurate personal data, and the completion of incomplete personal data. Under the conditions stipulated in Art. 17 of the GDPR, you have the right to obtain from us the erasure of certain of your personal data, such as data that are no longer necessary for legitimate purposes (such as the establishment, exercise, or defence of legal claims). Under the conditions stipulated in Art. 18 of the GDPR, you have the right to obtain from us the restriction of processing of certain of your personal data, such as data that you claim to be inaccurate. Under the conditions stipulated in Art. 20 of the GDPR, you have the right to receive, or request us to transfer to a third party, in a machine-readable format, personal data relating to you that are processed by automated means solely on the basis of your consent, or for the performance of a contract with you, or in order to take steps at your request prior to entering into a contract. Under the conditions stipulated in Art. 21 of the GDPR, you have the right to object, on grounds relating to your particular situation, to certain processing operations of your personal data. We may in such case not follow your objection if there are compelling legitimate grounds for the processing that override your interests, or if processing is necessary for the establishment, exercise, or defence of legal claims.

You should be aware that you are entitled to lodge a complaint with a supervisory authority. This may inter alia be the supervisory authority with jurisdiction at your domicile or with general personal jurisdiction over us. The supervisory authority with general personal jurisdiction over us is:
